Intra-Company Class

Traveling and working between countries is a typical requirement of many large multi-national companies. Canada’s immigration laws recognize that, and have specific provisions for Intra-Company Transferees. These provisions are similar to the Intra Company Transferee provisions under the North American Free Trade Agreement (NAFTA), and generally broader than those under the General Agreement on Trade and Services (GATS).

If you have been working with a company overseas, that wants to transfer you to Canada to work for the Canadian branch of your company; or set up a Canadian branch of the company; it is possible that you may be able to qualify as an Intra Company Transferee.

Qualifications - In order to qualify as an Intra Company Transferee, you must:

  1. Have worked with a parent, branch, subsidiary or affiliate of the Canadian company for at least 1 year in the past 3 years; and/or:
     
  2. Be working in either:  
  • a Senior Executive position;
  • a Senior Managerial position; or
in a position requiring Specialized Knowledge about your firm’s products, processes or services. It’s not necessary to be proprietary or unique, but it should be unusual or uncommon knowledge.
